1. Acceptance of Terms

Welcome to MyDD.ai (“Company,” “we,” “our,” or “us”). By accessing or using our website, mobile application, and artificial intelligence services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Services.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

2. Description of Service

MyDD.ai provides an artificial intelligence-powered platform designed to be a safe AI chatbot for kids, with parents in the loop. The Services may change from time to time without prior notice to you. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

3. Accounts and Eligibility

3.1 Age Requirements for Account Holders

To create a master account (“Parent Account”), you must be at least 18 years old and the legal parent or guardian of any minor you authorize to use the Services. Children under the age of 18 are not permitted to create their own Parent Accounts.

MyDD.ai complies with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent.

Consent: By creating an account and adding a child profile, you represent that you are the legal parent or guardian of the child and you consent to the collection and use of your child’s information as described in our Privacy Policy.
Verification: We may utilize methods approved by COPPA (such as credit card verification or identity matching) to verify that the person providing consent is the parent.

3.3 Authorized Minors

Subject to your compliance with these Terms, you may allow your child (an “Authorized Minor”) to use the Services under your supervision.

Responsibility: You acknowledge that you are solely responsible for your child’s activity on the Services and for ensuring they understand how to use the Services safely.
Revocation: You may revoke your child’s access at any time by updating your account settings or contacting support.

3.4 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to or use of your account. MyDD.ai is not liable for any loss or damage arising from your failure to safeguard your account information.

4. Privacy and Data Collection

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Collection: Our Privacy Policy explains how we collect, use, and share information, including personal information from children.
Parental Rights: Parents have the right to review the personal information collected from their child, request its deletion, and refuse further collection or use of the information. Please refer to the Privacy Policy for instructions on exercising these rights.

5. Artificial Intelligence Disclaimer

5.1 Accuracy of Output

The Services utilize artificial intelligence and machine learning technologies. You acknowledge that AI is an evolving field and that the Services:

May produce inaccurate, incorrect, or offensive information (“Hallucinations”).
Should not be relied upon as a substitute for professional advice (legal, medical, financial, etc.).

5.2 No Reliance

You agree that you will evaluate and bear all risks associated with the use of any output generated by MyDD.ai, including any reliance on the accuracy, completeness, or usefulness of such output.

6. User Conduct and Acceptable Use

You agree not to use the Services to:

Violate any applicable law or regulation.
Generate content that is hateful, violent, sexually explicit, or promotes illegal acts.
Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Services.
Interfere with or disrupt the integrity or performance of the Services.
Attempt to bypass or override any safety filters or content restrictions placed by MyDD.ai.

7. Intellectual Property

7.1 Your Content

You retain ownership of the input you provide to the Services (“Input”). Subject to applicable law, you also own the output generated by the Services based on your Input (“Output”). You grant MyDD.ai a worldwide, non-exclusive license to host, copy, and use your Input to provide and improve the Services.

7.2 Our IP

The Services, including our name, logo, algorithms, software, and interface, are the intellectual property of MyDD.ai and are protected by copyright and trademark laws.

8. Subscription and Payment

If you purchase a subscription:

Billing: You authorize us to charge your payment method for the fees associated with your plan.
Cancellation: You may cancel your subscription at any time; however, payments are non-refundable except where required by law.
Changes: We reserve the right to change our pricing with reasonable notice to you.

9. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDD.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;

(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MYDD.AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pennsylvania, USA, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
